Milwaukee. Wisconsin - On Thursday, Robert Allen Walczykowski Sr., 62, of 2143 S. 25 Street was charged with misdemeanor disorderly conduct for the October 10, 2022 assault of Trevon Burks, 24, who has a mental capacity of a 5-year-old. Walczykowski Sr. was caught on Facebook live video with his hand around Burks neck and holding him against his will and falsely accused him of taking part in stealing a bicycle with another unidentified individual during a 911 call.
If convicted, Walczykowski Sr. is facing up to 90 days in jail and up to $1,000 in fines.
Walczykowski Sr. court preliminary hearing is set for November 2, 2022 at 1:30 p.m. the Safety Building room 221.
In the Facebook video recorded by LivingLife Wright (DeAngelo Wright), Burks denies that he touched the bicycle, looked confused and frightened.
The Milwaukee County District Attorney's Office and police attempted to persuade Tracy Burks, his mother on October 10th not to press charges against WalczykowskiSr. who is White, but Tracy filed a criminal complaint against Walczykowski Sr.
A GoFundMe account for Burks has raised more than $70,780 of the $50,000 goal.
Black Live Matters activists, Black community activist Vaun L. Mayes and Darryl King Rick Farmer II and the Original Black Panthers including Walter Garron from the Brown Berets of Wisconsin have pushed for Walczykowski Sr. to face criminal charges.
Mayes released the following statement regarding Walczykowski Sr.'s charge, "Just another instance of how weak our DAs are. They literally complained that he was too disabled to give more info. They have video evidence and a witness statement. But we expected this. Took them 17 days to essentially give him a damn ticket. This should have gone to the DOJ or FBI as a hate crime, and it will since they are too incompetent to do their job correctly. What a slap in the face to both black and disabled people. So someone can think you know someone committed a crime and can hold you BY/WITH FORCE and get the same ticket as someone who yells too loudly in public."
Farmer II released the following statement, "IT IS INTOLERABLE AND UNACCEPTABLE THAT THE CITY AND COUNTY OF MILWAUKEE CONTINUES TO NOT TAKE THE PLIGHT OF THE BLACK AND BROWN IMPOVERISHED COMMUNITY!! A SPECIAL NEEDS BLACK MAN WAS CHOKED AND FALSELY ACCUSED OF STEALING A BIKE!! THE SUSPECT HILLBILLY BOB FELT THE NEED TO GRAB, CHOKE AND HOLD THIS YOUNG MAN AGAINST HIS WILL!! THE D.A. CARES NOTHING ABOUT OUR COMMUNITY!! WE DEMAND THE CHARGES BE AMENDED TO ASSAULT AND BATTERY ALONG WITH KIDNAPPING!! MILWAUKEE IS THE MOST RACIST AND HYPER-SEGREGATED CITY AND COUNTY IN AMERIKKKA!! ONCE AGAIN IT WAS SHOWN TO THE PEOPLE OF COLOR!! TIME TO RECALL THE D.A. JOHN CHISHOLM AND MAYOR CAVALIER JOHNSON!!"
