The Trump administration is operating as a totalitarian MAGA regime that has inadvertently declared war against the judicial branch, while the Dems are struggling to enforce due process and the rule of law as afforded by the U.S. Constitution.

Washington, D.C. - The arrest of Milwaukee County Circuit Court Judge Hannah C. Dugan, 65, by MAGA (Make Amerikkka Great Again) Federal Bureau of Investigation (FBI) agents in Milwaukee has become a national political and judicial spectacle over the lack of due process and disregard to the rule of law including the U.S. Constitution during the Trump administration immigration enforcement conducted by the MAGA led U.S. Immigration and Customs Enforcement (USICE) and its task force partners, the FBI, U.S. Drug Enforcement Administration (USDEA), U.S. Department of Homeland Security (USDHS), U.S. Department of Defense (USDOD), the U.S. Department of State (USDOS) and etc.. A Constitutional crisis has erupted by Trump's administration inadvertently declaring "War" on the judicial branch for blocking illegal acts by MAGA federal immigration enforcement agents operating under unconstitutional executive orders signed by Trump.
Trump enacted the antiquated Alien Enemies Act of 1798 by executive order, which allows the president to detain and deport citizens of countries the U.S. is at war with, or that actively invading or engaging in predatory incursions against the United States.
By engaging in the Alien Enemies Act without probable cause, since the U.S. is not at war with any country, the U.S. is not being invaded by predatory incursions against our country, so why is the Trump administration, USICE and USDHS allowed to illegally and unconstitionally abduct (kidnap) foreign individuals with legal status and non-legal status that have no criminal record and then have them removed from the U.S. without any due process by the USDHS and now the USDOD, according to Trump.
The Alien Enemies Act of 1798 doesn't automatically cancel or supercede the U.S. Constitution, even when enacted, it falls under the Constitution and due process must be afforded under the law.
In a guidance memo from U.S. Attorney General Pam Bondi dated March 14, 2025, it secretly allowed immigration enforcement agents to illegally invade the homes of suspected Tren de Aragua members without a warrant under the Alien Enemies Act of 1798. (Memo link: https://www.documentcloud.org/documents/25915967-doj-march-14-memo-alien-enemies-act/#document/p1)
Karoline Leavitt, the press secretary for the Trump administration indicated, that the White House and Trump don't believe that a federal judge has the authority to block Trump from removing individuals from the country under the Alien Enemies Act of 1798. The arrest of Milwaukee County Circuit Court Judge Dugan in Wisconsin by the Federal Bureau of Investigation (FBI) agents on Friday, April 25, 2025 for refusing to comply with a USICE administrative warrant and frivolously charged with obstruction of immigration agents (enforcing an alleged fake USICE agent signed warrant inside the courthouse) and concealing an undocumented individual (Eduardo Flores-Ruiz, 30) to evade arrest at the Milwaukee County Court House is ludicrous.
A USICE administrative warrant is not legal binding to make arrests in private property, in buildings including courthouses and other dwellings. Only a judicial warrant signed by a judge can allow arrests in private property, seize property and conduct a legal search.
In Judge Dugan's arrest, U.S. Magistrate Stephen C. Dries signed the warrant to take Dugan into custody. Magistrate Dries, the Eastern District of Wisconsin U.S. Attorney Richard G. Frohling and the FBI should know that a USICE administrative arrest warrant is not legal binding in private property or at any state/county courthouse, especially a courtroom and anyone can ignore it and decide not to comply. So, when did it become illegal for a County judge to show an alternative exit to an attorney and his client at a county courtroom. Federal agents have no jurisdiction at County courthouses, only if they are executing a judicial arrest warrant signed by a federal judge.

Trump by enacting the Alien Enemies Act of 1798 without just cause had expected for immigration enforcement agents to arrest and quickly remove undocumented and legal status individuals without due process from the U.S., even if they had no criminal record, but was blocked by a federal judge after lawsuits were filed. So far more than 100 of Trump's illegal and unconstitutional executive orders have been block by federal judges. (https://www.facebook.com/share/v/1G64yBWG9i/)
The Trump administration had warned the judicial branch, that if any judge would impede immigration enforcement, they would be arrested and prosecuted, despite blatant violations of due process by USICE and other federal agents operating in immigration enforcement, who are acting in disregard for the U.S. Constitution. The U.S. Congress MAGA Republicans who hold a majority in the U.S. House and U.S. Senate have not stepped up to hold Trump and his White House administration accountable for defying federal court orders, and not following the rule of law and acting in disregard for the U.S. Constitution.
