Milwaukee police officers from Milwaukee Police Station District 2 failed to process undocumented 38-year-old man after arresting him for an alleged state probation violation and turned him to ICE agents without any due process at the scene.

Milwaukee, WI - On Sunday, Kristine De la Cruz confirmed that she had called her husband's Wisconsin Department of Corrections Probation Officer Minerva Santiago-Gomez during the incident on Monday, September 23, 2019. De la Cruz says, that Santiago-Gomez had confirmed on the cell phone call that she hadn't issued a probation violation hold for her husband yet during the incident with police and U.S. rogue ICE agents in the Southside of Milwaukee. But, later Santiago-Gomez told De la Cruz that she issued a probation hold for De la Cruz-Espinosa for driving and she could also add additional violations without specifying what were the violations.
De la Cruz also told Hispanic News Network U.S.A. (HNNUSA) on Sunday that Santiago-Gomez's Wisconsin Department of Corrections (WIDOC) probation Supervisor had informed De la Cruz when contacted, that Santiago-Gomez's supervisor wasn't aware that Santiago-Gomez had issued a hold for De la Cruz-Espinosa, which the supervisor had to approve such a hold, according to De la Cruz.
So, why didn't MPD officers from Milwaukee Police Station District 2 processed De la Cruz-Espinosa for an alleged probation violation and kept him detained in state custody until it was later determined, if he actually violated his conditions for probation? Also, why did police decide to immediately turned De la Cruz-Espinoza to U.S. rogue ICE agents who apparently had no judicial warrant for his arrest.
De la Cruz says, that to date, she hasn't gotten any information why the WIDOC probation officer decided to place a hold on De la Cruz-Espinosa and if, Santiago-Gomez authorized police to turn De la Cruz-Espinosa to ICE agents.
One thing for sure, the De la Cruz family video recorded inside the vehicle shows De la Cruz-Espinosa in the back seat of the truck when taken into custody by police and not by ICE agents. U.S. ICE rogue agents had arrived first at the scene where the vehicle the De la Cruz family was in when parked and a police officer later passed by and was flagged by an ICE agent to help them take De la Cruz-Espinosa into custody, since they didn't have a judicial warrant for his arrest, according to video footage by members of Voces de la Frontera and the De la Cruz family.
On September 26, 2019, Newsweek reported that Robert Guadian, the U.S. Immigration and Customs Enforcement (ICE) Field Director in Chicago had said on a statement to them that, "To be clear, ICE does not ask local law enforcement agencies to enforce immigration law," Guadian said. "ICE called for MPD assistance, as we would any local law enforcement agency, when the situation appeared to escalate to ensure the safety of everyone involved." But in this case in Milwaukee, an MPD officer was used to illegally reach inside the vehicle through a partially open window and unlock the vehicle's locked doors without a warrant and De la Cruz was forced out of the truck by an officer, which an officer during a video recorded at the scene says that De la Cruz-Espinosa was arrested for a probation violation, which had just been entered in a computer at the scene of the incident when there was no active probation violation hold for De la Cruz at the time and then police turned him over to ICE custody. MPD officers from District Station 2, apparently managed to arrest him on a frivolous state misdemeanor probation violation hold to coverup their illegal acts.
Milwaukee police officers involved in the incident that including a K-9 dog unit from Milwaukee Police Station District 2 has certainly created a backlash from the Latino community in the Southside of Milwaukee and has generated distrust of local police officers in the undocumented community of color that actually pays their salaries as taxpayers.
HNNUSA found no court order documented on record in the De la Cruz-Espinosa case by a Milwaukee County judge authorizing that if he was found to violate any conditions of his probation case for a state misdemeanor conceal carry conviction, should De la Cruz-Espinosa be turned over to ICE for deportation proceedings without any due process in the state case.
De la Cruz-Espinosa has been in the U.S. for 17 years and has been married for 15 years and has three daughters ages 14, 13 and 11.
