Flyer Circulating On Recall Elections Set For Nine Wisconsin State Senators

Click on flyer to enlarge.

Flyer shows fake candidates in recall elections being circulated on Facebook and the Internet.

By H. Nelson Goodson
June 30, 2011

Madison - The Government Accountability Board (GAB) certified recall elections for nine state Senate legislators. The elections will include primaries on July 12 for candidates facing a challenger and elections on August 9, and August 16 for those not facing a challenger from the same political party. The GAB determined there were sufficient signatures for a recall election for each of the following three Senate Democrats, Dave Hansen, Jim Holperin and Robert Wirch. Also facing recall elections are six Senate Republicans, Alberta Darling, Randy Hopper, Robert Cowles, Luther Olsen, Sheila Harsdorf and Dan Kapanke.
The GAB also decided State Representative John Nygren (R) failed to collect the required 400 signatures to challenge Senator Dave Hansen (D) in 30th Senate District recall. The GAB claims Nygren had 398 valid signatures and not enough valid signatures, but Nygren filed a lawsuit challenging the GAB decision to keep him off the ballot.
The GOP encouraged for fake candidates to run in an effort to allow Republicans more time to campaign.
The Republicans have been recall for voting to eliminate collective bargaining rights for most state employees. The Democrats are being recall for leaving the state for a month to stall a vote to eliminate union state employees to engage in collective bargaining.
Governor Scott Walker (R) will be facing a recall himself after he completes one year in office. Walker signed into law Act 10, which eliminates most collective bargaining rights for most state employees. Act 10 became effective on June 29, after it was published in the Wisconsin State Journal. He also signed a two-year budget last Sunday, which eliminates in-state tuition for undocumented immigrants and cuts $800 million from public school districts in the state, but boosts tax credits for businesses.
On Wednesday, the Milwaukee Public Schools District (MPS) Superintendent Gregory Thorton announced, that the district is sending layoff notices this week to 519 employees affected, it includes 354 teachers, 155 teaching assistants and 96 District Divisions will be eliminated. Thorton blamed Governor Walker's budget cuts of $89 million from MPS. At least 418 positions left vacant by retirees won't be filled. About 200 layoff notices could be rescinded, if union workers concede to further contribute to their pensions and health insurance. Union officials say, employees have already conceded to contribute millions into both health and pension plans.

Seattle Police Department embarrassed about mishap.

June 28, 2011

Seattle, WA - The Seattle Police Department (SPD) is trying to do damage control after a police assault rifle was left on top of a squad car unattended. KING 5 News reported that a pedestrian noticed the mishap in front of a hotel on Monday night and took a picture of it. Nick Gonzales took the picture about 9:00 p.m. outside the Roosevelt Hotel.
SPD confirmed that Police Officer William Collins placed the assault rifle outside another squad trunk while loading his squad, then Lt. Deanna Nolette came out and drove away without noticing the weapon on her back trunk. Collins didn't immediately report the weapon missing, until the department discovered the mishap when multiple citizens called in and reported the weapon on top of a squad car trunk.
Gonzales even flagged down several bicycle SPD police officers and told them about the incident. SPD didn't confirm, if the weapon was loaded.
The SPD Office of Proffessional Accountability released a statement, "It is unacceptable that a rifle was left unattended on a patrol car and people should expect more from their police department."
An internal investigation was initiated by John Diaz, Chief of Police, according to KING 5 News.

Walker Revokes In-state Tuition For Undocumented Students Attending Universities And Colleges In Wisconsin

Governor Scott Walker

Undocumented students to pay higher tuition, despite living and paying state taxes along with parents in Wisconsin.

By H. Nelson Goodson
June 27, 2011

Ashwaubenon - On Sunday, Wisconsin Governor Scott Walker (R) signed his two-year 2011-2013 budget, which included ending in-state tuition for undocumented students attending public universities and colleges. In-state tuition for undocumented students was approved two years ago by former Governor Jim Doyle (D) after the Hispanic community struggled for 10 years to pass it.
The State Journal (SJ) reported that about 100 undocument students had applied for in-state tuition at 13-four year University of Wisconsin System public universities in 2010-2011. In 2009-2010, SJ data showed that 70 undocumented students had applied for in-state tuition to attend UW universities. UW-Milwaukee qualified 33 students in 2009-2010 and 55 in the 2010-2011 academic year. Other UW campuses had fewer applicants.
In Wisconsin, undergraduate sudents residing in the state pay more than $8,900 per year to attend UW compared to non-residents that pay more than $24,200 per year. The resident undergraduate pays 60 percent of the tuition and the state pays the other 40 percent of the cost, according to the SJ data.
With Wisconsin ending in-state tuition for undocumented students, only 11 states remain in the U.S. that offer in-state tuition to undocumented students.
Undocumented students and their parents residing in Wisconsin for years, whether illegally in the U.S. do contribute economically and do pay their fair share of state taxes, including sale taxes and other taxes as well. But, they don't get reimbursed at the end of the year.
The budget takes effect on July 1st. Walker's $66 billion two-year budget tries to balance and cap a $3.6 billion deficit without raising taxes. The budget cuts $800 million in public school aid, reduces $250 million from the University of Wisconsin System, cuts 30% or $72 million of aid to technical colleges and limits how much local governments and school districts can raise property taxes. A projected $1.6 billion in reduction of revenues for both local governments and school districts.
Walker signed his two-year budget at the Fox Valley Metal-Tech's Plant in Ashwaubenon near Greenbay. More than 200 protestors were outside the company with signs calling Walker, "You dirty rat" and "Shame, shame."
The Greenbay Press Gazette reported that according to Walker's budget, property taxes on owners of median-valued homes are projected to increase just $54 over two years.
  • Income tax credits for poor families with two or more children would be reduced by $56 million over two years, a move Democrats described as a tax increase.
  • Household income levels to qualify for a homestead tax credit for poor home owners and renters would be frozen, saving the state more than $13 million over two years.
  • Creates a new capital gains tax deferral for investments in Wisconsin-based companies worth $36 million over two years.
  • Creates a new tax credit for manufacturers and agricultural businesses worth about $129 million a year once fully phased in starting in 2016.
  • Loosens taxes charged to multistate corporations, a break to them worth more than $46 million over two years.
  • Cuts $500 million from Medicaid through a variety of reforms including increasing co-pays and deductibles, but not by reducing benefits across the board or cutting provider reimbursement rates.
  • Cuts aid to local governments by $76 million.
  • Eliminates 1,032 state positions, most of which have been vacant for more than a year.
  • Provides $225 million to rebuild the Zoo Interchange in Milwaukee.
  • Provides $195 million to continue reconstruction of Interstate 94 between Milwaukee and Kenosha.
  • Closes the Ethan Allen School, a detention facility for boys, and moves inmates to Lincoln Hills School in Lincoln County.
  • Closes the Southern Oaks Girls School, a detention facility for girls, and move the inmates to Copper Lake School at Lincoln Hills, the Greenbay Press Gazette reported.
Walker also vetoed 50 items, including ending pay for Milwaukee Police Officers who are fired, while they appeal their cases. The bondsmen provision was also killed by Governor Walker who said, these items didn't belong in the budget.
Governor Walker is facing a recall for ending collective bargaining and drastically cutting public education funding, once he completes one year in office.

Rosga, Milwaukee Outlaws Leader Sentenced To 20 Years In Federal Prison For Racketeering

Jack Rosga, aka, "Milwaukee Jack"

Outlaws engaged in drug trafficking and armed assaults to protect their criminal enterprise, according to the USDOJ.

By H. Nelson Goodson
June 18, 2011

Washington, D.C. - In April, the U.S. Department of Justice (USDOJ) in a press released announced that U.S. District Judge Henry E. Hudson sentenced the national president of the American Outlaw Association (Outlaws) motorcycle gang to 20 years in prison for leading a violent criminal organization. The national president of the Oulaws organization, Jack Rosga, aka, “Milwaukee Jack,” 53, was found guilty on Dec. 21, 2010, of conspiring to engage in racketeering activities and conspiring to commit violence in aid of racketeering. To date, 27 individuals have been charged as a result of a long-term investigation into criminal activities of the Outlaws motorcycle gang. Twenty have either pled guilty or were convicted at trial, according to U.S. Attorney Neil H. MacBride of the Eastern District of Virginia; Assistant Attorney General Lanny A. Breuer of the Criminal Division; and Rich Marianos, Acting Special Agent in Charge of the Bureau of Alcohol Tobacco, Firearms and Explosives’ (ATF) Washington Field Division.
“Jack Rosga led an outlaw motorcycle gang that was violent at its core,” said U.S. Attorney MacBride. “As the gang’s national president, Mr. Rosga declared war on the rival Hell’s Angels and ordered violent acts on rival gang members. Mr. Rosga admitted to undercover federal agents that he expected to go to jail for leading this violent motorcycle gang, and the jury convicted him of conspiracy to commit racketeering and violent acts. He spent decades dedicated to a criminal way of life, and he’ll now spend decades in prison paying for those crimes.”
Leaders and members of the Outlaws in multiple states including Wisconsin, Maine, Montana, North Carolina, Tennessee, South Carolina and Virginia are charged in a June 2010 indictment. Under Rosga’s leadership, the enterprise is alleged to have engaged in violent racketeering activities with the intent to expand its influence and to control various parts of the country against rival motorcycle gangs, particularly the Hell’s Angels.
Court records indicate that the Outlaws planned multiple acts of violence against rival motorcycle gangs, including shows of force at the Cycle Expo in Henrico County, Va., in 2006; Dinwiddie Racetrack in Virginia in 2008; the Cockades Bar in Petersburg, Va., in 2009; Daytona Bike Week in Florida in 2009; and the Easyrider Bike Expo in Charlotte, N.C., in 2010. The indictment alleges that in the Cockades Bar show of force, members of the Pagans Motorcycle Club joined the Outlaws in the assault against rival gangs.
In addition, the evidence showed that in 2008, the Outlaws established a clubhouse in Rock Hill, S.C., in territory traditionally controlled by the Hell’s Angels. The Outlaws understood that this act would create violent friction between the two organizations.
Court records also established that in September 2009, two members of the Outlaws were assaulted in Connecticut by members of the Hell’s Angels. This caused the Outlaws to increase their already violent approach to the Hell’s Angels in retaliation. In October 2009, this led to the alleged attempted murder of a Hell’s Angels member outside the Hell’s Angels’ clubhouse in Canaan, Maine. The victim was seriously injured from gunshot wounds to his neck.
Evidence during trial showed, that on April 17, 2010, Outlaw members of the Milwaukee and other Wisconsin chapters in the Gold Region participated in a charitable event known as the Flood Run crossing from Wisconsin into Minnesota where they brutally beat members of the Hell’s Angels and stole their club patches, also known as “colors.”
Witnesses at the trial also testified that the Outlaws regularly used and distributed narcotics and regularly used firearms or other dangers weapons, according to the USDOJ press release.

Most of the Hispanic population that was cut from District 4 was added to District 12, which in 2010 had 70.4% of Latinos and currently has an HVAP of 66%. With the new population addition to District 12 for 2012, it will have 70.1%, which lost 3% population of Hispanics.
The current 4th District Supervisor is Marina Dimitrijevic and the 12th District Surpervisor is Peggy A. Romo West, an Hispanic. During the April MCRC meeting Supervisor West addressed the committee members and said, that the County electors in the 12th District elected the first Hispanc in 2004 in the County's 365-year history. West told the committee that information was provided to the community and she was satisfied with the new proposed plan. However, West didn't realized that she actually voted to approve the plan, which would prevent District 4 from becoming a 70% Hispanic District by adding 11.4% of Latinos, according to audio recorded during the MCRC meeting. Supervisor Dimitrijevic was also at the meeting, but did not comment about the proposed changes to her District.
With the current Hispanic population in County District 4, the Latino community only needs a projected 11.4% increase of Hispanics to make it a 70% Hispanic District to compensate the population growth. It would create a second Latino District for the community with the ability to gain political empowerment by electing an Hispanic representative (Supervisor) at the Milwaukee County level. If the MCRC tentative proposed plan to cut the 4th District by 6.9% is approved for 2012. Latinos would need to increase the population by 18.3% to get at least 70% of the Latino population, which in fact would be a major setback for Hispanics in Milwaukee County.
Latinos involved with the last two decades, including the 2000 redistricting plan, which gained 38% of the Hispanic population in the District saw a growth of 20% of the Latino population in the District. The HVAP in Distric 4 increased from 31% to 51% within 10 years, since 2000.
The current population in Milwaukee County District 4 contains 58.6% Hispanic population and a 30.5% White population with the proposed changes for 2012, it will be 51.7% Hispanic and 37.9% White, and other ethnic groups, according to the 2012 Proposed Supervisory District Totals by Race.
The MCRC accomplished the plan by taking Wards 132, 290, 291, and part of 292 with large Latino populations from District 4 and moved them to the 12th. Ward 132 is 70% Hispanic, Ward 290 is 58% Hispanic, Ward 29 is 73% Hispanic and Ward 292 is 67.3 % Hispanic.
The MCRC to compensate for the removal of large proportions of the Latino population Wards, they moved other Wards into the 4th. Ward  59 from District 3 (Downtown area or Eastern portion), which is 86.3% White and 3.4% Hispanic. The MCRC also moved Wards 144 and 200 from District 16 to 4.  Ward 144 is just south of the current District 4. Ward 144 is 45% White and 45% Hispanic. Ward 200 is 63% White and 21.8% Hispanic.
The MCRC overall did move 4,743 of the Hispanic population out of District 4 and 5,248 were moved into the 4th District, which created a decline in Hispanic population and an increase in White population.
The total populations for both County Districts in 2010 are 4th District, 53,087 and the 12th District is 47,889. Total populations for tentative plan in 2012 are, 4th District, 53,982 and the 12th District is 53,930.
Milwaukee County had an increase of 43,000 in Hispanic population and a state wide increase of 143,000, an 74% growth in the last 10 years, according to the U.S. Census.
Members of the Milwaukee County Redistricting Committee are Milwaukee County Supervisors, Michael Mayo Sr. (Chairperson), Gerry P. Broderick, Peggy A. Romo West, Mark A. Borkowski, Johnny L. Thomas, John F. Weishan Jr. and Willie Johnson Jr.

Update: The following Milwaukee County Supervisor Peggy West email to Harold Mester, the Public Information Manager for Milwaukee County was released several days before the 2012 election concerning her explanation about the two majority Hispanic Districts.

Minnesota Governor Dayton Expecting Government Shutdown By July First

Governor Mark Dayton warns state employees of possible government shutdown come July, if the legislature doesn't pass a budget.

By H. Nelson Goodson
June 15, 2011

St. Paul, MN - On Wednesday, Governor Mark Dayton (D) sent an e-mail to all state employees confirming the notices that were sent out last weekend of a possible government shutdown. Dayton wrote. "This weekend you received notices that, unless a budget is enacted by July 1st, state government will shut down most of its operations. Most of you would be laid off or placed on an unpaid leave of absence until government operations resume. This was an extremely difficult decision for everyone involved; however, we had no choice but to begin planning for this possibility... Today we have submitted a list to the Ramsey County District Court, which ultimately will decide what services will continue past. July 1st, if shutdown occurs... Thus my decisions were based entirely upon which functions of state government are so critical to protecting the lives and safety of the people of Minnesota, or which, if terminated, would cause such disorder or severe statewide economic impact, that they should be made exceptions to the Constitution's clear prohibition."
Both the state Senate and House of Representatives would have to pass a bi-partisan budget before July to keep the state government running, until a permanent budget economic solution is reached.
Today, Minnesota is facing more than $6.2 billion deficit, which is the highest on record in the state's 152-year history. Former Governor Tim Pawlenty (R) left office with the largest deficit the state of Minnesota has ever experienced along with higher property taxes, more fees for the middle class and effecting small businesses throughout the state, including drastic education cuts that left most school districts with a four day week.
For the 2012 and 2013 Biennium, "Minnesota is facing a $6.2 billion deficit in the upcoming biennium, up from earlier projections of $5.8 billion. The shortfall represents about 16 percent of the state's two-year budget." Source: Minnesota Public Radio, 12/2/10

Hank Rhon's Defense Team Claims Mexican Military Planted Arsenal And Turned Over Video Evidence To Judge

Jorge Hank Rhon

Mexican military accused of planting arsenal at Hank Rhon's residence in Tijuana.

By H. Nelson Goodson
June 12, 2011

Tijuana, Baja California, Mexico - On Friday, Fernando Benítez Álvarez del Castillo, an attorney for former Tijuana Mayor Jorge Hank Rhon, 55, announced that the allegations against his client and the arrest report by the Mexican Federal Attorney General's Office (PGR) conflicts with actual events taped by home surveillance video footage from Rhon's home. Álvares del Castillo confirmed, Rhon's defense team had turn over 120 minutes of 5 hours of video footage from 8 home video cameras as evidence that will show no weapons exclusively used by the military were confiscated at Rhon's residence other than the handguns that were properly registered and licensed to Rhon's security detail.
Some of the video shows how the military disarmed the private security guards at the home and how the main gate unarmed security guard was mishandled when detained in the raid.
The surveillance video was being taped at another location and the military disabled some cameras at Rhon's residence, but failed to secure the video footage from a different location, according to the defense team.
The video footage was turned over to Judge Blanca Evelia Parra Meza, from the Mexican Federal 9th District Court in Baja California who is presiding over the case. Judge Meza who reviewed the video footage went to Rhon's residence on Saturday to inspect Rhon's residence.
Vladimir Téllez another attorney for Rhon has said, the military lacked a search warrant at the time of Rhon's arrest and the video evidence shows the weapons used exclusively by the military were not at Rhon's residence.  Also, the military did not come in through the front of the residence as the PGR criminal complaint states.
The defense team is claiming the Mexican military planted the weapons to frame Rhon for illegal possession of a military arsenal and ammunition used by the arm forces.

State Immigration Enforcement Bills Useless, Costly And Unable To Be Legally Implemented In The U.S.

Alabama, another state to pass an immigration enforcement bill.

By H. Nelson Goodson
June 10, 2011

Montgomery, Alabama - On Thursday, Republican Governor Robert Bentley signed into law a state immigration enforcement law targeting 120,000 undocumented immigrants in Alabama. The bill allows state and local law enforcement officers to determine the legal status and arrest suspected undocumented immigrants during traffic stops or civil violations. The bill allows public school officials to determine the legal status of students attending school districts as a data collection, makes it unlawful for people to knowingly give a ride to undocumented immigrants or cause traffic jams while picking illegal laborers up and requires businesses to verify the legal status of employees that they hire using the federal system E-verify. The law takes affect on September 1.
The 2010 U.S. Census reported, that 186,000 Hispanics reside in Alabama, a 3.9 growth within a decade.
Immigrant rights groups, the American Civil Liberties Union (ACLU) and the Southern Poverty Law Center agreed that the Alabama immigration enforcement law will lead to racial profiling by law enforcement, employers and landlords. The Alabama law is deemed unconstitutional because it's pre-empted by federal law. Only the federal government can regulate and enforce immigration laws.
Most of the provisions in the Alabama immigration enforcement law will most likely be blocked from taking effect once it is legally challenged in federal court as Arizona's SB 1070 is facing today. Arizona's own immigration enforcement law has been stalled, since it was passed almost a year ago. A federal judge blocked most of its provisions making SB 1070 useless.
It has cost Arizona more than $250 million to attempt to implement it and to legally defend. National and state boycotts have kept millions of dollars and tourists from the state creating an economic crisis and adding to the $33 billion dollar state deficit Arizona is currently facing.
Alabama is expected to spent just as much in a law that will most likely never be fully implemented. Georgia is facing the same fate and Utah's law, which actually allows undocumented immigrants to seek permits to work and reside in the state along with their families has been also blocked in a federal court challenge.
Wisconsin is currently trying to pass an immigration enforcement measure Assembly Bill 173, which will fall into legal limbo as well and cost taxpayers millions to legally defend, if approved.
Some of these states enacting immigration enforcement laws are facing major deficits and continue to create unwanted costs for taxpayers by passing useless and dead immigration bills, once they are legally challenged.

Pridemore's Immigration Enforcement Measure Moves Forward As Wisconsin Assembly Bill 173

Anti-immigrant bill in Wisconsin moves forward as Assembly Bill 173

By H. Nelson Goodson
June 9, 2011

Madison - On Wednesday, Representative Donald Pridemore's (R-Hartford) state immigration enforcement measure moved forward as Assembly Bill 173. The state immigration bill AB 173 was officially referred to the Assembly Committee on Homeland Security and State Affairs chaired by Representative Karl Van Roy (R), the Office of Representative JoCasta Zamarripa (D) announced Thursday. AB 173 will remain in committee until Roy decides to address the issue and then debate the immigration enforcement bill.
The AB 173 bill, if approved by the Wisconsin controlled Republican legislature and signed into law by Governor Scott Walker (R) will authorize state and local enforcement officers to ask and dermine the legal status of people stopped for minor and civil violations. The bill will lead to racial profiling and will outlaw cities from becoming a sanctuary to undocumented immigrants, according to Voces de la Frontera, clergy and immigration rights activists who oppose the measure.
People who can't provide legal proof when stopped and questioned about their legal status will be detained up to 48 hours at their own cost and then turned over to the U.S. Immigration Customs and Enforcement (ICE), according to Pridemore's bill. ICE hasn't confirmed that if the bill passed, they would take undocumented immigrants arrested under AB 173. The bill relates to local ordinances determining the lawful presence of a person arrested for or charged with a crime or certain civil violations, and provides a penalty.
AB 173 is sponsored by state Republican Representatives, Pridemore (author), Evan Wynn, Daniel LeMahieu, Joel Kleefisch, Jim Steineke, Andre Jacque and one state Senate Republican Frank Lasee (co-author).
The Wisconsin immigration bill will most likely cost taxpayers an estimated $250 million to legally defend, including a state boycott keeping away tourist spending, lack of revenue in taxes and wages similar to Arizona's economic loss attributed to passing their immigration enforcement bill SB 1070. Arizona's bill hasn't been able to be implemented and major provisions of SB 1070 have been blocked in federal court.
Wisconsin is facing a $3.6 billion dollar deficit and the Pridemore immigration bill will add unwanted costs to taxpayers.

The Republicans have been recall for voting to eliminate collective bargaining rights for most state employees. The Democrats are being recall for leaving the state for a month to stall a vote to eliminate union state employees to engage in collective bargaining.

Madison - State legislators from the Wisconsin Joint Committee on Finance had to order State and Capitol Police to remove at least ten people who disrupted their budget cuts hearing to finalize fiscal spending for the next two years. Two protesters were arrested. They vowed to continue the protests in the coming days.
The committee finally met late on Thursday after changing their meeting time several times in the afternoon, trying to diminish crowds. The prostesters were against educational cuts and the proposed repeal of in-state tuition in Governor Scott Walker's budget cuts.
The state joint finance committee is holding a two year spending proposed budget hearing and their version once approved heads for the full Senate. State Representatives have their own budget cuts version and both the Assembly and the Senate would have to agree on a joint version to pass it.
The Republican controlled legislature is moving forward to repeal in-state tuition for undocumented students attending public colleges and universities.
In a press release statement, Voces de la Frontera states that fifty concerned Wisconsinites engaged in an organized, non-violent civil disobedience to halt passage of the state budget, demanding restoration of the cuts to education and in-state tuition for immigrant youths.
Kicking off the action were four prominent community leaders, Jesus Salas, former University of Wisconsin Regent; Larry Miller, Director on the Milwaukee Public School Board; Al Levie, Racine high school teacher and REA union member; and Christine Neumann-Ortíz, Voces de la Frontera executive director.
The disruption stopped the committee for an extended period of time as police carried off speaker after speaker, who refused to let injustice and austerity become law without resistance. Each speaker read a statement before being removed from the hearing.
They have disregarded widespread opposition to their proposed cuts to education, environment, workers, healthcare and other vital public services. Today, the Republicans on the committee delayed the hearing for 5 hours, afraid to face the public backlash, according to Voces de la Frontera.
