Michael Schafrik's Homicide By 14-year-old Teen Ruled Justified By Milwaukee D.A.

A Milwaukee Southside 14-year-old teen will not be charged with Michael Schafrik's homicide, according to the Milwaukee County District Attorney's Office.

Milwaukee, WI - On Monday, the Milwaukee County District Attorney's Office decided not to file homicide charges against a 14-year-old teenager who was also injured while struggling with a Michael Schafrik, 40, over a handgun. Apparently, Schafrik suffered a fatal wound after he pulled a handgun on the 14-year-old teenager and the teenager managed to struggle with Schafrik when the handgun fired striking Schafrik in the stomach and striking the teenager in the thigh.
According to the teenager's sister on Facebook, the altercation started when Schafrik's stepson got him involved in an argument between two groups at the 1000 block of W. Lincoln Ave. Schafrick on January 5 around 4:30 p.m. pulled a handgun out on her brother, the 14-year-old teenager who then struggled with Schafrik to take it away and the gun fired striking both the deceased victim and the teen. 
Another 14-year-old teenager and Shada Morales Cruz, 33, were taken into custody as well. No charges will be filed against the teen and Cruz.
Cruz told police, Schafrik drove up to them and pulled a handgun, but had it tucked away when the struggle happened for the gun.
