Milwaukee, WI - On Monday, Nico E. Tineo, 18, was sentenced to three years in prison for one felony count of homicide by negligence use of a dangerous weapon, but will do one year incarceration with 136 days credit and two years of extended supervision under a plea agreement. Tineo under the plea agreement pleaded guilty on March 14, to a lesser charge, which was amended from second-degree reckless homicide to homicide by negligence for the November 17, death of Leandro Marin. Tineo was facing up to 25 years in prison and $100,000 in fines for the prior felony charge.
Tineo was also order to pay $5,725 restitution to several funeral homes, $4,465 to John Rago Sons Funeral Home and $1,260 to Fairview Memorial Park Cemetery for Marin's funeral costs, according to court records.
Marin, 17, of Greenfield was shot inside a vehicle by Tineo at the 1800 block of S. 32nd Street in Milwaukee.
The criminal complaint states, Marin and Tineo found a backpack under a bench at Burnham Park while accompanied by Marin's sister and another teen. They got into a Cadillac Escalade. Tineo who was in the back seat went through the backpack and found a semi-automatic handgun.
Tineo apparently fired the gun facing out of the Escalade and the gun jammed while the rest watched. Tineo tired to unjammed the weapon, but couldn't and handed it to Marin who was seating in the front seat, so he could unjam the handgun. Marin couldn't remove the cartridge or unjam it and returned the handgun to Tineo.
Tineo then was able to unjam it, while placing his finger on the trigger and accidentally fired the weapon striking Marin in the back killing him.
Tineo apparently call 911 and stayed at the scene until police arrived. The teens told police that they had smoked marijuana before leaving the park.
Tineo is well known in the Milwaukee area teen circuit for his promising singing career as one of the lead singers for the Yung Ducez. The Yung Ducez have been performing Reggaetón, Hip Hop and R&B for more than ten years.
