Johnson, UW-Milwaukee Student Association Vice President Arrested On Allegation Of Sexual Assault

Milwaukee - On Wednesday, the Milwaukee County District Attorney's (MCDA) Office confirmed it will not charged Brent Johnson who was taken into custody on Sunday for alleged sexual assault of a woman. Johnson spent the night in jail and has told local media outlets that he is innocent.
The woman alleged that Johnson sexually assaulted her around September. It would be difficult to prosecute Johnson because no evidence was gathered from the victim after the assault, according to the MCDA's office.
Johnson is currently a junior at the University of Wisconsin-Milwaukee (UWM) and Student Association (SA) Vice President. UWM has launched an internal investigation concerning the alleged sexual assault. Johnson, if found responsible and actually committed the alleged sexual assault could face expulsion or suspension from UWM. He has been temperarily put on administrative leave from his position as SA vice-president until the outcome of the case, according to Michael Laliberte, Vice Chancellor of Student Affairs.

Feds Discover Tunnel With Elevator Stretching Between Mexico-U.S. Border

San Diego, CA - On Wednesday, the U.S. Immigration and Customs Enforcement (ICE) reported that a 640-yard long tunnel stretching between Tijuana, Mexico and San Diego was discovered by the San Diego Tunnel Task Force. Six suspects were taken into custody and confiscated at least $65 million in marijuana.
The news release says, that the tunnel on the U.S. was hidden in an Otay Mesa industrial park warehouse and its passageway had an electric rail system, reinforced walls, lighting, wooden floors and ventilation.
In Mexico's side, Mexican authorities found an elevator under a warehouse building leading to the tunnel. The tunnel's entrance is accessed through a hydraulically controlled steel door and an elevator concealed beneath the warehouse floor. At the bottom of the tunnel shaft is a large storage room where agents recovered approximately three tons of marijuana. Another ton of marijuana was piled in bundles near the tunnel's entrance. Meanwhile, investigators searched the Otay Mesa building that housed the tunnel's U.S. entry point, where they found another 20 tons of marijuana wrapped in plastic and stacked neatly on pallets.
The drug bust unfolded on Monday night, when ICE Homeland Security Investigations (HSI) observed a tractor trailer truck parked over night at the Otay Mesa warehouse. On early Tuesday, the feds observed a man who picked up the truck and drove it to Los Angeles. Feds moved in after the driver parked the truck at a warehouse in the City of Industry, Calif. There, he pulled into the parking lot of a warehouse located at 14837 Proctor Ave. and, together with three other individuals, began unloading the trailer's contents.
The feds then made their bust after a two year investigation. They seized 11 tons from the truck and a total of 32 tons had been recovered in the joint drug bust totaling almost $65 million.
Two other suspects linked to the scheme were arrested overnight in Baldwin Park, California. The six defendants, all Hispanic males, are expected to be charged on Wednesday in federal court in Los Angeles and San Diego.
The passageway uncovered Tuesday is the seventh large-scale drug smuggling tunnel discovered in the San Diego area, since 2006. In the last four years, federal authorities have detected more than 75 cross-border smuggling tunnels, most of them in California and Arizona, according to ICE's news release.

Mission, Texas - On Friday, police responded to a shooting at a local residence. They found Joaquin Luna Jr., 18, with an apparent self-inflicted fatal gunshot wound to the head inside the home. Family members told police investigators that Luna put on a suit, kissed them each and then went into the bathroom. Moments later they heard a gunshot.
When Diyra Mendoza, his brother went to check the bathroom. He found Luna unresponsive, dead and noticed a fatal wound to the head. Mendoza told KGBT Action 4 News that Luna was distraught about not being able to go to college because "He didn't see no other way or no other option" due to his illegal status. 
Luna was one of the several million of young students who would have qualify under the DREAM Act to remain in the U.S. The DREAM Act would provide a pathway to citizenship for undocumented students who were brought to the U.S. at a young age of 16, and complete at least two years of college or military service. But the act failed to pass Congress in 2010. Mendoza says, letters left behind by Luna indicated that he was very disappointed about the DREAM Act not being approved and his options to remain in the U.S. or pursue a college education, which remained blocked.
On Tuesday, Valley Central dot com reported that Luna was an "A" and "B" student who attended Juarez-Lincoln High School in Mission. Principal Clem Garza told Valley Central dot com, that staff who knew Luna said, he never mentioned the DREAM Act or never showed any signs and feelings that the failure of Congress to pass the DREAM Act would prevent him from succeeding or getting into college. Luna had an essay and an e-mail where he was planning to send an essay to several universities to apply for scholarships and was eager to fulfill his goal of becoming an engineer, according to Garza. Garza holds copies of both the essay and an e-mail from Luna showing his intend to go to college, despite his illegal status.
Luna's family members continue to stand by their belief that Luna took his life due to his illegal status and that he would be prevented from going into college.
Dr. Alda T. Benavides, Superintendent of La Joy Independent School District in a letter of condolecenses to the Luna family stated, that Luna was a model "A" student and "excelled not only academically, but also stood out as an excellent guitar player."
In early December of 2010, the Congressional Budget Office (CBO) report indicated that the approval of the DREAM Act would help cut the federal deficit by $1.4 billion, and generate $2.3 billion in corporate and social insurance taxes within the next ten years. http://bit.ly/fk6B3N
That same year, the DREAM Act was killed in the U.S. Senate because it failed to get the needed 60 votes to prevent a filibuster inorder for the bill to proceed for a Senate vote.
A UCLA study concluded that DREAM Act participants could contribute $1.4 - $3.6 trillion to the U.S. economy during their working lives. College students under the DREAM Act are expected to earn about 60% more than students with only a high school education, according to the White House.

Feld Entertainment, A Circus Production Company Agrees To Pay $270,000 In Violation Of The Animal Rights Act

Corporation admitted no wrong doing, but agreed to pay penalty and to train all employees who handle animals.

Washington, D.C. - On Monday, the U.S. Department of Agriculture (USDA) reported that Feld Entertainment, Inc., which operates the Ringling Brothers and Barnum & Bailey Circus, had reached a settlement agreement and paid a civil penalty of $270,000 for alleged violations of the Animal Welfare Act (AWA) dating from June 2007 to August 2011, according to a news release from the USDA. Under the agreement, Feld also did not admit to any wrong doing.
Feld waived the opportunity for a hearing and agreed to develop and implement annual AWA compliance training for all employees who work with and handle animals, including trainers, handlers, attendants and veterinarians starting March 31, 2012. and to establish an AWA compliance position on its staff by February 28, 2012.
All Feld employees who will work with and handle animals must complete the training within 30 days being hired.
The USDA investigation resulted from unannounced inspections and citizen complaints of animal mishandeling by workers at the circus.

Recall Walker Organizers In Wisconsin Reported 300,000 Petition Signatures Gathered In Just 12 Days

It's official, recall Governor Scott Walker organizers confirming they have passed halfway mark to force a statewide recall election.

Milwaukee - On Monday, an e-mail from United Wisconsin reported that 300,000 recall Republican Governor Scott Walker petition signatures have been collected surpassing the halfway mark to force a recall election. "Over 300,000 signatures in 12 days-that is over 1,000 per hour," United Wisconsin reported. Signatures were collected throughout the 72 counties in the state.
The remarkable outpour of eligible voters in Wisconsin has broken the organizers own record of collecting signatures before the January 17 dateline, despite a suspected Republican operated website Occupy-Madison that falsely reported that all the 540,000 signatures needed for a recall had been collected as of last weekend. The Occupy-Madison Facebook site has been shut down and the state's Government Accountability Board (GAB) is investigating, if its administrator violated any laws for falsely reporting that all signatures had been collected.
On Saturday, Hispanic News Network U.S.A. (HNNUSA) first reported that recall organizers had collected at least 270,000 signatures or were close to surpassing the halfway mark to recall Governor Walker. Websites and social networks shared and tapped into the breaking news story. The HNNUSA story then spread like wildfire through the Internet. The main stream media finally picked up the news story on Monday, after organizers officially confirmed it had surpassed the halfway mark to force an election.

Milwaukee - On Saturday, Recall Wisconsin Governor Scott Walker (R) projections to collect petition signatures have surpassed all expectations to get more than the minimum required signatures per day needed by organizers to meet the 540,000 mark by January 17. After the Black Friday statewide signature petition drive, recall organizers projected that most likely they have surpassed the halfway mark of the 270,000 signatures needed or will reach the halfway target total within days to force an election recall against Governor Walker.
Within the first week of the Walker recall, organizers and volunteers collected at least 105,000 to 107,000 petition signatures within four days of the initial start date (Nov. 15), exceeding all expectations.
The Committee to Recall Scott Walker and United Wisconsin were expected to collect the 9,000 minimum per day for 60 days, but have collected threefold of signatures per day and continue to gather the needed signatures to force a recall election.
The recall effort needs to get the needed 540,000 signatures by January 17. Organizers say, they are working to get at least 650,000 to 700,000 signatures.
On Monday, the Wisconsin Democratic Party will officially announce current and updated signature total for statewide Governor Scott Walker recall.
Early reports indicated and alleged that some Republican supporters were pretending to collect recall signatures for the purpose of destorying them or not turning them in to the state Government Accountability Board (GAB) had surfaced. The Wisconsin GOP has condemned the act and does not support the illegal act. Petition signers are permitted to sign once and can't sign any other petition for the same recall.
Last week, One Wisconsin Now (OWN), a non-profit organization announced that a $10,000 reward fund has been established to help get information leading to the arrest, prosecution and conviction of a person or persons destroying or defacing petition signatures. The reward is good between, November 22 thru January 14. Under state law, anyone convicted of a felony act for intentionally destroying recall petitions could face up to three years in prison and a fine up to $10,000 or both.
Milwaukee County District Attorney John T. Chisholm says, it's a felony to get recall Governor Walker petition signatures and not turn them in to the GAB. Chisholm says, he will prosecute those who intentionally collect signatures for the purpose of destroying them or not turning them in to keep electors from exercising their right for a recall.
Governor Walker is being recall for eliminating most collective bargaining rights from most state employees. He also cut $800 million from public school funding and repealed in-state tuition for undocumented students attending state universities and colleges.
In addition to recalling Walker, a separate recall petition was also filed online to recall Rebecca Kleefisch, (R) Wisconsin's Lieutenant Governor. Another 540,000 valid petition signatures are needed to recall Kleefisch as well.
A Wisconsin poll shows 6 of 10 people in the state favored recall effort to oust Republican Governor Scott Walker. Several polls by Wisconsin Public Radio and St. Norbert with a 5% margin of error indicated that this Fall about 58% favored removal from office compared to last Spring's 47%; 38% felt Walker should stay in office compared to last Spring's 48% and not sure was 4% compared to last Spring's 5%.

Milwaukee City Election Commission Unable to Control Campaign Violations Of Posting Before December

Milwaukee - On Wednesday, after a follow up of an exclusive story about a potential 12th District Aldermanic candidate José G. Pérez who allegedly posted a campaign sign at a local Southside record store before the required date of December 1, has raised concern about committing a city campaign violation. Several Pérez signs were noticed at a local business window at the 400 block of W. National Ave.
Another campaign poster was spotted on Wednesday in the window of La Mexicana Records, at the 1100 block of W. Lincoln Ave. Salvador Jimenez from La Mexicana Records said, that Pérez himself came to the store and asked permission to post the sign. He posted the sign himself about several weeks ago, Jimenez said. Jimenez won't pulled the sign off the window, but said that Pérez himself needs to pull it.
Neither, Pérez or Susan M. Edman, Executive Director of the City of Milwaukee Election Commission could be reached for comment on Wednesday.
Unfortunately, the Election Commission, including the City Attorney's Office lacks strict enforcement of election campaign rules and the Pérez campaign committee seems to be taking advantage of the laxed election rules in the City of Milwaukee. Other related reports by several people indicated that Pérez might not be the only one violating campaign rules, but that other potential candidates in the near Southside have also began posting prohibited election campaign signs in the area as well.
Last Friday, Edman, from the Election Commission confirmed that candidates running for public office can't put up or have their campaign signs displayed at private properties or public places before December 1st. Nomination papers will begin circulating on December 1, to gather the required signatures for candidates to get on the ballot for each prospective elected position.
Candidates or people posting an election campaign sign before December would be in violation of election rules.
Several signs for Pérez, were posted last week at the corner of the 1000 block of W. Washington St. Since the story broke out on Hispanic News Network U.S.A., the posters were removed immediately by a unkown person or persons.
Last week, Pérez also could not be reached for comment after several unsuccessful attempts to his campaign phone number.
Edman could not elaborate further or if a penalty was warranted when contacted on November 18, about the Pérez election campaign sign violation other than it was a violation. She said, that she would look into it, since it hasn't happened in the pass.
When contacted, 12 District Alderman Jim Witkowiak, who is running for re-election said, he won't put up his campaign signs until Dec. 1st as required by the election commission.
Pérez is the only candidate that has registered his campaign committee to challenge Alderman Witkowiak in the 12th District.

U.S.A. - On Tuesday, J.R. Martinez, an Iraq veteran and his partner Karina Smirnoff, a professional dancer won first place in the 13th ABC season of Dancing with the Stars. They received the Mirror Ball Trophy for their win.
Martinez suffered a major injury while serving in Iraq and was inspired and encouraged by his mother to move forward in life. A national win on a major television network was a hard working accomplishment for Martinez.

Utah Became Fourth State Sued By USDOJ Over State Immigration Enforcement Law

Department of Justice continues to sue states defiant of federal enforcement of immigration laws.

Washington, D.C. - On Tuesday, the U.S. Department of Justice (USDOJ) announced in a news release, that it had filed a federal lawsuit in Salt Lake City against the state of Utah for passing and trying to implement an immigration enforcement law. USDOJ claims, several provisions of Utah’s H.B. 497 are preempted by federal law. The provisions were enacted on March, 15, 2011.
The department notified Utah state officials of its position that the Utah’s Immigrant Guest Worker statutes, H.B. 116 and H.B. 469, are clearly preempted by federal law. Given that the provisions do not take effect until 2013, and in light of the constructive conversations the department continues to have with Utah officials about these provisions pursuant to the Justice Department’s long-standing policy of exploring resolution short of litigation before filing suit against a state, the department is not challenging these provisions today, according to the release.
Utah became the fourth state to be sued and an injunction is being sought to stop the state from implementing the immigration law.
Three other states, Arizona, Alabama and South Carolina have been also sued and have pending federal cases. The USDOJ have won injunctions to halt implementation of state immigration enforcement laws in all three states.
All of the lawsuits, the USDOJ claims that the state's immigration enforcement laws are unconstitutional and preempts federal enforcement of immigration laws, solely reserved for the federal government.
"The federal government is the chief enforcer of immigration laws, and while we appreciate cooperation from states, which remains important, it is clearly unconstitutional for a state to set its own immigration policy," U.S. Attorney General Eric Holder stated in a news release. "A patchwork of immigration laws is not the answer."
The USDOJ is reviewing state immigration bills in Indiana and Georgia for possible lawsuits as well, according to Holder. The USDOJ previously challenged S.B. 1070, H.B. 56, and Act No. 69 on federal pre-emption grounds in Arizona, Alabama and South Carolina. The department continues to review immigration related laws that were passed in Indiana and Georgia. Courts have enjoined key parts of the Arizona, Alabama, Georgia and Indiana state laws and temporarily restrained enforcement of Utah’s law.
House state legislators in Pennsylvania recently passed an immigration enforcement bill. The state will also be targeted for a federal lawsuit, once it approves the the bill.
The suit was filed on behalf of the Departments of Justice, Homeland Security and State, which share responsibilities in administering federal immigration law. The department will soon request a preliminary injunction to enjoin enforcement of the certain provisions of H.B. 497.

Bauer's Trial Set For December In "Mule Smuggling" Heroin Case In The Dominican Republic

Santo Domingo, Dominican Republic - Three Judges, Victor Lebrón, Odelina Salvador Reyes and Eduardo de los Santos Rosario for the Second Tribunal Court in Santo Domingo have set a trial hearing date for December 12 for Jaime Vargas, aka, "Jimmy Bauer," a local known bachata singer from New York City. Bauer is being held on charges for trafficking and trying to smuggle heroin into the U.S.
A hearing for Bauer on November 14, was rescheduled after prison (jail) authorities in Najayo failed to present him at court for the hearing. Court records indicate, Bauer is trying to make a plea agreement in the case and is currently going for a psychiatric evaluation for minor mental disorder behavior.
Bauer has been held in jail since, November 1, 2010 after being arrested for trying to smuggle one kilo of heroin in his stomach, known as "Mule Smuggling." He collapsed at the Santo Domingo International Las Americas Airport when detained for suspicous behavior and minutes after a small pellet full of heroin ruptured inside his stomach. The rupture caused an overdose that almost killed Bauer.
After an x-ray, doctors at a military hospital later removed 88 pellets (small balloons) of 1.04 kilogram totalling 2.2 pounds of pure heroin that Bauer had injested.
If Bauer would have made the flight to the U.S., most likely he wouldn't have survived the flight, according to authorities.

Sinaloa Cartel Lost $15.3 Million In Cash During Seizure By Mexican Military In Tijuana

Tijuana, Baja California, Mexico - On Tuesday, the Mexican Secretary of Defense (Sedena) and the Mexican Federal Attorney General's Office (PGR) announced during a press conference in Mexico City, that a military patrol discovered and confiscated more than $15,350,000 million U.S. in cash and $215,038,150 pesos ($16.5 thousand U.S.) inside a vehicle during a routine stop. They also found jewelry and 3 packages of cocaine (3 kilograms), two high power rifles, two small weapons believed to belong to the Sinaloa Cartel operating in the Tijuana region. The cash seizure was made last Friday at the Cumbres de Juárez neighborhood in Tijuana.
The PGR reported it was the second largest cash seizure by the military since September 14, 2008, when $26.2 million in U.S. cash was seized from the Sinaloa Cartel in Culiacán, Sinaloa.
It's the second largest financial blow to Sinaloa drug lord Joaquin "El Chapo" Guzman Leora, who remains a fugitive and a $5 million U.S. dollars reward has been offered by the U.S. government. The Mexican government has created a special task force to locate El Chapo. He has eluded authorities for ten years after escaping from a Mexican prison.

Pimentel Charged With Attempted Terrorist Acts In New York City

New York, New York - On Sunday, New York City Mayor Mike Bloomberg during a press conference announced the arrest of Jose Pimentel, 27, of Washington Heights for alleged criminal attempt to make a bomb to commit a terrorist act. Police investigators acted and took Pimentel into custody before he could act. Pimentel, a U.S. citizen, who was born in the Dominican Republic was arrested on Saturday and is being held without bail.
Police had been investigating Pimentel since 2009 and was about ready to commit a terrorist act. He converted to Islam and went by the name of Muhammed Yusef.
He was charged in Manhattan criminal court with five counts, including terrorism, criminal possession of a weapon and attempting to murder service members returning from Iraq, Afghanistan and to also attack NYC police officers.
Mayor Bloomberg described Pimentel as an Al Qaeda sympathizer who was plotting to bomb police patrol cars and also postal facilities, as well as target members of our Armed Forces returning from abroad.
Pimentel was influenced by Islam radical cleric Anwar al-Awiaki extreme terrorist beliefs. He learned to built a bomb from a known terrorist magazine called "Inspire" from a website called TrueIslam 1, according to police.

Milwaukee - On Sunday, recall volunteers along with Christine Neumann-Ortiz, Executive Director of Voces de la Frontera (VDLF), an immigrant and workers rights organization were at the 900 block of S. Cesar E. Chavez Dr. outside of El Rey Supermarket collecting signatures to force a recall election against Republican Governor Scott Walker. Neumann-Ortiz says, that the recall effort had collected at least 107,000 petition signatures within four days, exceeding all expectations. Voces Action, the political branch of VDLF also began a collection drive at their local office at 1027 S. 5th St., where eligible electors can stop and sign the recall Governor Walker petitions.
Organizers for the recall effort to remove Governor Walker from office have announced that the groups involved have collected more than 105,000 recall petition signatures within the last four days. The Committee to Recall Scott Walker and United Wisconsin were expected to collect at least 9,000 signatures per day for 60 days, but have surpassed all expectations of collecting per day and continue to gather the needed signatures to force a recall election.

Milwaukee County District Attorney John T. Chisholm says it's a felony to get recall Governor Walker petition signatures and not turn them in to the GAB. Chisholm says, he will prosecute those who are intentionally collecting signatures for the purpose of not turning them in to keep electors from exercising their right for a recall.
Governor Walker is being recall for eliminating most collective bargaining rights from most state employees. He also cut $800 million from public school funding and repealed in-state tuition for undocumented students attending state universities and colleges.
In addition to recalling Walker, a separate recall petition was also filed online to recall Rebecca Kleefisch, (R) Wisconsin's Lieutenant Governor. Another 540,000 valid petition signatures are needed to recall Kleefisch as well.
A Wisconsin poll shows 6 of 10 people in the state favored recall effort to oust Republican Governor Scott Walker. Several polls by Wisconsin Public Radio and St. Norbert with a 5% margin of error indicated that this Fall about 58% favored removal from office compared to last Spring's 47%; 38% felt Walker should stay in office compared to last Spring's 48% and not sure was 4% compared to last Spring's 5%.

Planned ICE Private Prisons In FL, IL, NJ, TX and CA To Hold Non-criminal Illegals

ICE and Corrections Corporation of America plan to build non-criminal illegal immigrant detention facilities in Florida, Illinois, Texas, New Jersey and California, despite national discretionary policy to grant stays for undocumented immigrants.

Southwest Ranches, Florida - The Associated Press (AP) and other media sources like Latino Fox News (LFN) have reported an ongoing proposed plan for the last 10 years between local government officials at Southwest Ranches, Corrections Corporation of America (CCA) and U.S. Immigration and Customs Enforcement (ICE) to build a private run detention facility to hold between 1,500 to 2,500 beds for non-criminal illegal immigrants. A majority of the Southwest Ranches residents have opposed the proposed facility and claimed that the parties negiotiating the plan have failed to publicly let the community know what are the actual details in the last decade. Most residents became aware of the proposed detention facility after ICE finally announced the proposed plan this year.
CCA and Southwest Ranches government officials have managed to maintain secrecy to try and avoid opposition, which has risen despite attempts to keep details under the table. Southwest Ranches with a population of 7,000, has been struggling to meet a $9 million dollar budget and most homes are valued at $100,000 or more.
Mayor Jeff Nelson hopes that CCA and ICE can finally come into agreement and approve the detention facility plan, which is expected to cost Southwest Ranches about $150,000 per year to keep it operating and in return would get 4 percent payment from ICE of what it pays CCA to run a facility.
Proposed plans for other detention facilities in San Antonio, Texas; Crete, Illinois; Essex County, New Jersey and Orange County, California has drawn less controversy or opposition than Southwest Ranches, according LFN. The new proposed private detention facilities would help relieve over capacity in local and county jails around the country.
A conservative estimate for 150,000 bed facility at Southwest Ranches would generate about $400,000 in revenue, if partially filled to capacity and $400,000 in real estate taxes. The facility in Boward County bordering with the City of Pembroke Pines would cost between $100 to $200 million to build making it the largest illegal immigrant detention facility in the country. It would provide 300 permanent jobs, which two-thirds would be for guards.
On Friday, the Diario de Mexico USA reported that CCA is planning to build another non-criminal illegal immigrant detention private facility in Crete, Illinois. The prison would be located about 30 miles South of Chicago.
According to the article, Thomas Durkin, CCA administrator had confirmed that the corporation and local city officials in Crete had tentatively approved a contract to build it.
Today, CCA generates $200 million annually from 12 percent of federal revenue for operating ICE detention facilities, according to a CCA company revenue report.
The Detention Watch Network (DWN) reported that since the late 1990’s, the number of people held in immigration detention has exploded. On any given day, ICE detains over 33,000 immigrants; this is more than triple the number of people detained in 1996. In the last 5 years alone, the annual number of immigrants detained and the costs of detaining them has doubled: in 2009, 383,524 immigrants were detained, costing taxpayers $1.7 billion at an average of $122 a day per bed. In the U.S., an average of 75,000 illegal immigrants (inmates) are held in more than 60 private prison facilities in 19 states including Washington, D.C. In Florida alone, there are 5 private detention facilities.
Last Thursday, the U.S. Department of Homeland Security (DHS) and the U.S. Department of Justice (DOJ) began a national comprehensive training program for ICE agents to begin enforcement of a discretionary policy to screen non-criminal and criminal illegal immigrants detained. Federal prosecutors and ICE agents will now be expected to review 300,000 case-by-case detentions to determine and deport those illegal immigrants that have returned illegally to the U.S., been convicted of serious and felony criminal acts.
Those illegal immigrants who have been detained, but are not considered dangerous, a national security threat, young school children and college students considered DREAMERs (who would qualify under the DREAM Act), elderly, undocumented veterans and heads of families that are dependent to support families won't be prioritised for deportation.
Those detainees considered recipients of the ICE immigration discretionary stay policy will be able to qualify for legal yearly stays, which would be determined during immigration hearings. The action to allow non-criminal detainees to remain in the U.S. is expected to relieve the conjested federal immigration court system.
With the proposed ICE and CCA plans to continue to build private detention facilities to hold non-criminal illegal immigrants in various states can only mean one thing, that massive non-criminal deportations will continue as usual throughout the U.S. But, if the ICE discretionary policy actually works and allows thousands of non-criminal illegal immigrants to qualify for year long stays, then the CCA proposed detention center facility in Southwest Ranches, Florida and in other states, IL, NJ, TX and CA are obsolete and a waste of federal funding and spending.
Federal prosecutions of illegal immigrants have increased by 42 percent within the first two years, since President Barack H. Obama took office. The federal prison system reported an increase of incarcerations of illegal Hispanic convicted felons for returning to the U.S. after they were deported.
So far, more than 1 million illegal immigrants have been deported under Obama's Presidency. ICE despite the stay policy will continue to deport more than 1,000 illegals per month or more than 400,000 per year.
Overall, in Fiscal Year (FY) 2011 ICE's Office of Enforcement and Removal Operations removed 396,906 individuals, which is the largest number deported in the agency's history. Of these, nearly 55 percent or 216,698 of the people removed were convicted of felonies or misdemeanors, an 89 percent increase in the removal of criminals since FY 2008. This includes 1,119 aliens convicted of homicide; 5,848 aliens convicted of sexual offenses; 44,653 aliens convicted of drug related crimes and 35,927 aliens convicted of driving under the influence.
Of those illegal immigrants convicted of crimes who were detained and removed, 107,000 were flagged by the Secure Communities program, according to ICE.

Leon-Velazquez Probation Revoked In Stabbing Case

Milwaukee - Last Thursday, Jose Luis Leon-Velazquez, 42, had his four-year probation revoked by the Wisconsin Department of Corrections Probation and Parole in connection with the stabbing of a woman. He had served one year for a prior drug related charge and was given four years probation in the case. He was out of prison just two months, when he allegedly stabbed the victim.
The probation revocation resulted with Leon-Velazquez violating his conditions, he violated a restraining order, had been in a bar and had been drinking.
He was charged with a felony count of first-degree reckless injury in connection with the stabbing of a 28-year-old woman. Leon-Velazquez is accused of stabbing the victim once during a domestic incident on September 5, in Milwaukee's South side.
The criminal complaint states, after stabbing the victim Leon-Velazquez drove her to the hospital and dropped her off without going into the hospital. He then went home to pack his clothes on bags and was intending to flee the city.
Police arrested Leon-Velazquez at the 1400 block of W. Washington St. He was found hidden in an upper apartment building closet and several bags were packed containing Leon-Velazquez clothes.

Gonzalez Sentenced To 20 Years In Prison For John's Reckless Homicide In Milwaukee

Milwaukee - On Friday, Milwaukee County Circuit Court Judge Richard J. Sankovitz sentenced Jesus Gonzalez, 24, to 25 years in prison. Gonzalez will only be confined to 20 years and will serve five years probation for the May 8, 2010 homicide of Danny John, 29, and shooting of his nephew, Jered Corn, 22, at the 3300 block of W. National Ave.
In October, Gonzalez was convicted for first-degree reckless homicide and first-degree reckless injury. Gonzalez actually got 25 years in prison for the reckless homicide and 10 years concurrent for the reckless injury count.
According to the criminal complaint, both John and Corn were drinking all day and had just left Mamie's tavern on W. National Ave. and S. Shea Ave. when an apparent altercation with Gonzalez occurred. John was driving his Honda Accord out of Mamie's tavern when Gonzalez fired his weapon at least seven shots hitting John four times and striking Corn in the neck paralyzing him for life.

Milwaukee - On Friday, Susan M. Edman, Executive Director for the City of Milwaukee Election Commission confirmed that candidates running for public office can't put up or have their campaign signs displayed at private properties or public places before December 1st. Candidates or people posting an election campaign sign before December would be in violation of election rules.
Several signs for potential candidate José Pérez, who intends to run in the Aldermanic 12th Distict were posted at the corner of the 1000 block of W. Washington St.
Pérez could not be reached for comment after several unsuccessful attempts to his campaign phone number.
Edman could not elaborate further or if a penalty was warranted when contacted on Friday about the Pérez election campaign sign violation other than it was a violation. She said, that she would look into it, since it hasn't happened in the pass.
When contacted, 12 District Alderman Jim Witkowiak, who is running for re-election said, he won't put up his campaign signs until Dec. 1st as required by the election commission.
Pérez is the only candidate that has registered his campaign committee to challenge Alderman Witkowiak in the 12th District.

Milwaukee - On Thursday, organizers for the recall effort to remove Republican Governor Scott Walker from office announced that the groups involved have collected 50,000 recall petition signatures within 48 hours. The Committee to Recall Scott Walker and United Wisconsin were expected to collect at least 9,000 signatures per day for 60 days, but have surpassed all expectations of collecting per day and continue to gather the needed signatures to force a recall election.
The recall effort needs to get the needed 540,000 signatures by January 17, organizers say they are working to get at least 650,000 to 700,000 signatures.
Some reports of Republican supporters pretending to collect recall signatures for the purpose of not turning them in to the state Government Accountability Board (GAB) had surfaced. Feds Began Reviewing Illegal Immigrant Deportation Cases To Determine Who Can Stay In The U.S.

Washington, D.C. - On Thursday, the U.S. Department of Homeland Security (DHS) and the U.S. Department of Justice (DOJ) began a national comprehensive training program for U.S. Immigration and Customs Enforcement (ICE) agents to begin enforcement of a policy to screen non-criminal and criminal illegal immigrants detained. Federal prosecutors and ICE agents will now be expected to review case-by-case detentions to determine and deport those illegal immigrants that have returned illegally to the U.S., been convicted of serious and felony criminal acts. Being in the U.S. illegally is a federal civil violation and not a federal criminal act, unless the individual has been priviously been deported.
The recent action taken by the DHS, DOJ and ICE to screen detainee cases was authorized by an administrative discretionary memo (internal policy) introduced back in June by John Morton, ICE Director and supported by the Obama administration. In the memo, Morton orderd all ICE field office directors, special agents in charge and all chief counsels to use or exercise prosecutorial discretion dealing with the apprehension detention and removal of illegal immigrants.
Instead, ICE and the Obama administration have focused on prosecuting those illegal immigrants who have been deported, but had decided to returned to the U.S illegally once more, which federal prosecutions increased by 42 percent within the first two years, since President Obama took office. Pittsburgh, Pennsylvania - On Thursday,  Oscar Ramiro Ortega-Hernández, 21, of Idaho Falls, Idaho was charged with attempting to assassinate President Barack H. Obama or members of his staff. Ortega-Hernández appear before a U.S. magistrate judge in Pittsburgh. The judge told Ortega-Hernández that federal prosecutors from Washington D.C. were seeking an extradition request for him to face charges in D.C. Ortega-Hernández said in court, that he understood the charge. He is facing life in a federal prison, if convicted.
Ortega-Hernández told authorities, that he was the modern day Jesus Christ and Obama was the Antichrist. A belief, that led Ortega-Hernández to act and shoot at the White House where Obama lives. He also thought that the federal government was conspiring against him, according to the federal criminal complaint.
On Wednesday, Ortega-Hernández was taken into custody in connection with last Friday's White House shooting incident. He was arrested around 12:35 p.m. without incident at a hotel near Indiana, Pennsylvania (PA) by the PA State Police, according to the Secret Service.
Last Friday, Ortega-Hernández allegedly fired several shots around 9:00 p.m. at the White House in Wshington, D.C. during a drive-by. His vehicle was found five minutes later and a weapon (AK-47) that was traced back to Ortega-Hernández was recovered by U.S. Park Police and the Secret Service. Authorities say, the AK-47 was registered to Jake Chapman, 21, who sold it to Ortega-Hernández in March.
Two bullets hit the White House building, one was stuck in a bullet proof window and the other in the building exterior. Bullet castings were recovered along the 1600 block of Constitution Ave., the Secret Service reported.
President Barack H. Obama was not at the White House when the shooting occurred, the Secret Service reported.
Ortega-Hernández was reported missing on October 31, by family members in Idaho who described him as a Mexican-American. He had just moved in the D.C. area several weeks ago, the investigation revealed.
U.S. Park Police were able to get a photo of Ortega-Hernández on Friday morning when investigating a call that a suspicious man was loitering around a D.C. suburb.
Ortega-Hernández apparently has a history of mental related treatments.

Indiana, Pennsylvania - On Wednesday, the U.S. Secret Service confirmed the arrest of Oscar Ramiro Ortega-Hernández, 21, of Idaho Falls, Idaho in connection with last Friday's White House shooting incident. Ortega-Hernández was taken into custody around 12:35 p.m. at a hotel near Indiana, Pennsylvania (PA) by the PA State Police, according to the Secret Service.

Morales-Rodriguez Held For Killing Mother To Get Unborn Child Accused Of Attacking Milwaukee County Corrections Officer

Milwaukee - On Wednesday, the Milwaukee County Sheriff's Department confirmed that Annette Morales-Rodriguez, 33, held at the County jail for the early October homicides of both Maritza Ramirez-Cruz, 23, and her unborn son, Omar had attacked a corrections officer at the jail. On Monday, Morales-Rodriguez allegedly attacked a 52-year-old female Milwaukee County Corrections Officer (MCCO) around 10:00 p.m. after tampering with her holding cell locking mechanism. The door failed to lock and when the MCCO tried to check the mishap, Morales-Rodriguez then attacked the MCCO. They struggled last for at least seven minutes, until the MCCO was able to break free and overpowered Morales-Rodriguez. The MCCO couldn't reach for her radio because Morales-Rodriguez grabbed it and threw it into a cell keeping the MCCO from calling for help. She also got the MCCO's handcuffs and during the struggle, the MCCO suffered minor injuries, including scratches and scrapes, according a Milwaukee County Sheriff's news release.
The MCCO reported that after the attack, Morales-Rodriguez returned the radio and said, she "just wanted to go home," according to David Clarke, Milwaukee County Sheriff. The incident of the attack is under investigation.
Morales-Rodriguez is facing felony assault charges for attacking a MCCO and could get up to six years in prison. She has been put of a suicide watch.
On November 2, Morales-Rodriguez pleaded not guilty by reason of mental disease or defect for the Ramirez-Cruz homicide. She was charged with two counts of 1st-degree homicide, including intentional homicide of a child while armed. Morales-Rodriguez bail was set at $1 million and if convicted, she is facing two life terms in prison.
The criminal complaint states, that Morales-Rodriguez pretended she was going to have a child, but couldn't get pregnant. She desperately wanted a boy and went looking for a victim that was pregnant with a boy and was about to give birth.
Morales-Rodriguez saw Ramirez-Cruz walking along Chase Ave. and gave her a ride. Morales-Rodriguez was able to lure Ramirez-Cruz to her home where she killed her and savagely cut her unborn child from Ramirez-Cruz body. The child was also killed in the process of being extracted, according to the criminal complaint.
The alleged killer, Morales-Rodriguez has three children and the victim, Ramirez-Cruz had three children as well. Neither of them knew each other.

Second Hit-and-Run Milwaukee Victim Dies After Taken Off Life Supports

Milwaukee - On Tuesday, Edward Giovanni Lindsey, 20, of Beloit, Wisconsin was pronounced dead at about 2:38 a.m. after family members decided to take him off a life support machine at Froedtert Hospital. Lindsey was the son of Frances Pizarro, 49, of Norcross, Georgia who was killed on a hit-and-run incident on November 6, at the 1400 block of W. Greenfield Ave. in Milwaukee's South side. Pizarro was originally from New York, New York and was in Milwaukee visiting relatives.
The hit-and-run driver, Martin Rodriguez, 41, has been charged with 6 felonies for killing Pizarro, including 2 counts of homicide by intoxicated use of a vehicle and one misdemeanor for knowingly operating a vehicle while license revoked causing death.
With Lindsey's death, Rodriguez will face another felony count of homicide by intoxicated use of a vehicle.
Rodriguez is being held on a $500,000 bail and a federal immigration hold has been placed, according to the Milwaukee County Sheriff's Office. The U.S. Immigration and Customs Enforcement hasn't confirmed, if Rodriguez in undocumented.
The criminal complaint states, Rodriguez who was driving a truck had tried to elude police after they noticed he was driving recklessly in the 1800 block of W. Greenfield Ave. He sped east on W. Greenfield in an excess of speeds between 80 to 90 miles per hour and hit both Pizarro and Lindsey while they crossed the street. Pizarro died at the scene and Lindsey remained in critical condition for a week and a half.
Rodriguez failed to stop until his truck crashed at the 600 block of E. Greenfield and then tried to escape from police by jumping into the Milwaukee Harbor. He was pulled from the cold lake and placed on custody.
Blood alcohol test results confirmed Rodriguez had a Prohibited Alcohol Concentration of 0.206, more than twice the legal limit of Blood/Breath Alcohol Concentration (BAC) 0.08 permitted. Rodriguez had three prior convictions for driving under the influence, state court records indicate.

Milwaukee - Last Friday, both Rebecca M. Chandler, 22, and Raven Larabee, 20, aka, "Scarlett" accused of inflicting more than 300 stab, larcerations and slashed wounds were released from the Milwaukee County Jail. They were being held on more than $100,000 bail each.
Both women got into a sexual encounter at the 900 block of E. Knapp St. with Ruben Vati, 18, of Phoenix, Arizona and while his hands were bound with duct tape in bed. During the sex acts, Chandler and Larabee took turns in slashing, puncturing and inflicting wounds that bled in Vati's body. Vati suffered more than 300 wounds to his body, the Froedtert Hospital medical staff reported, according to a police affidavit search warrant.
Vati had been reluctant to press charges. The Milwaukee County District Attorney's Office hasn't confirmed, if the state will take over the case and prosecute.

Wanted Puerto Rican Drug Lord Morales Davila Arrested By Island Police

San Juan, Puerto Rico - On Tuesday, a news release from the U.S. Immigration and Customs Enforcement (ICE) reported that ICE Homeland Security Investigation special agents working jointly with Puerto Rico Police Department's (PRPD) Air and Marine Unit arrested Carlos Morales Davila, 39, aka, "Cano Navarro" or "Cano Gurabo," on Monday wanted in the state of Florida for federal drug trafficking charges.
Morales Davila was arrested by ICE HSI special agents after the vessel he was traveling from the neighboring island of Vieques to Puerto Rico was intercepted by PRPD marine enforcement units.
Upon inspection by PRPD officers, Morales Davila provided a form of identification that did not match his physical characteristics.
PRPD alerted ICE HSI agents who waited for Morales Davila ashore for a fingerprint check that later identified him as a suspect wanted in Florida for a four count sealed federal indictment that included drug trafficking.
Morales Davila had his initial appearance before U.S. Magistrate Judge Camille Rive on Tuesday and was transferred to the Guaynabo, Puerto Rico Metropolitan Detention Center awaiting the outcome of his case and extradition to Florida.
Morales Davila has been linked to a drug trafficking organization in eastern Puerto Rico responsible for the importation of multi-kilograms of cocaine and several homicides, according to the ICE news release.
In an urelated federal drug bust in Puerto Rico, ICE HSI special agents working jointly with the PRPD seized 225 kilograms of cocaine on Tuesday from a residence in Humacao on the eastern coast of Puerto Rico with an estimated street value of $4.5 million.
During the execution of the search warrant, ICE special agents noted 205 bricks of a powdery white substance that tested positive for cocaine, as well as 10 small bags which later tested positive for marijuana during a field test. No arrests have been made in the case.

Milwaukee - On early Tuesday, hundreds of volunteers and supporters gathered at multiple Committee to Recall Scott Walker offices in Milwaukee, West Allis, Beaver Dam, Wausau, Eau Claire, La Crosse, Appleton, Madison and Elkhorn to be the first to sign official recall petitions. Organizers officially filed the recall petition drive online with the State Government Accountability Board.
Organizers and volunteers need to get at least 540,000 valid petition signatures by January 17 to launch a recall election. They expect to get about 650,000 signatures within the next 60 days.
Governor Walker is being recall for eliminating most collective bargaining rights from most state employees. He also cut $800 million from public school funding and repealed in-state tuition for undocumented students attending state universities and colleges.
In addition to recalling Walker, a separate recall petition was also filed online to recall Rebecca Kleefisch, (R) Wisconsin's Lieutenant Governor. Another 540,000 valid petition signatures are needed to recall Kleefisch as well.
A Wisconsin poll shows 6 of 10 people in the state favored recall effort to oust Republican Governor Scott Walker. Several polls by Wisconsin Public Radio and St. Norbert with a 5% margin of error indicated that this Fall about 58% favored removal from office compared to last Spring's 47%; 38% felt Walker should stay in office compared to last Spring's 48% and not sure was 4% compared to last Spring's 5%.

Milwaukee's Popular E&J Record Store To Close After 17 Years

E&J owners made difficult decision to close local community Hispanic music store due to slow sales contributed by a stagnant economy in Wisconsin.

Milwaukee - On Monday, Eduardo and Leslie Velez confirmed, that the popular South side Hispanic music store will finally close after 17 years of business. "The E&J Record music store will close on December 31," Eduardo said.
Eduardo elaborated that recent slow sales, stagnant economy in the state and the threat of passing a copycat Arizona SB 1070 law in Wisconsin pushed hard working decent loyal customers to leave the state. A majority of business sales at E&J Record, 1242 S. Cesar E. Chavez Drive was generated by Mexican music CD's, movies, videos, including guitars and other instruments used by local groups. About 80% of the customer base were Mexican nationals, but since the adoption of the Arizona state immigration enforcement bill SB 1070 and Wisconsin legislators proposing a similar copycat bill led to gradual slower and fewer sales.   
Eduardo says, a large liquidation sale will begin a day after Thanksgiving Day on Black Friday and discounts of 20% to 30% will follow. He said, "I love the business and it was a hard decision to make. But, I had to make the right decision and choose what's best for my family." Eduardo strongly believes that proposed anti-immigrant bills contributed to the economic revenue loss in the city and state.
Wisconsin legislators, have propose three anti-immigrant bills in the state, which forced and actually pushed undocumented immigrants to leave Milwaukee and the state. The repeal of in-state tuition undocumented immigrants in the state by Republicans in the legislature and Governor Scott Walker (R) has also contributed to keeping low income immigrant students from higher education.
Many undocumented immigrants went back to Mexico and others have decided to remain in the U.S. and continue the struggle for a comprehensive immigration reform bill.
One of the state's anti-immigration proposed bills is similar to SB 1070, which would allow police to question the legal status of immigrants during traffic violation stops or domestic investigations. The two other proposed bills include, to legally deny public services to undocumented immigrants, eventhough they pay taxes and the third bill would penalize employers up to $10,000 for knownly hiring an undocumented employee.
The anti-immigrant bills have been tabled for now, but with the Republican controlled legislature and Governor Walker promise to sign such bills, if they come to his desk has triggered an exodus of undocumented immigrants in the state.

Rivas, Who Glorified Mexican Sinaloa Cartel Drug Lord El Chapo In Songs Killed In Culiacán

Culiacán, Sinaloa, Mexico - On Sunday, the Sinaloa state police confirmed that Diego Rivas, a lead singer for the Guaruras had been killed. Rivas is best known for glorifying Sinaloa Cartel drug lord Joaquin "El Chapo" Guzman Loera.
A group of gunmen arrived around 4:00 a.m. at the Lázaro Cárdenas nieghborhood where Rivas and several other people had shared a residence. The gunmen opened fire with AK-47's and fatally shot Rivas at the home along with Alfredo Herrera Gómez, 24. Another victim, Jeffrey Olguín, 22, later died of injuries at a nearby hospital. Three other people were wounded, but are expected to survive. The injured were identified as, Héctor Manuel Peñuelas León, 22, Jesús Armando López Ibarra, 22, and Lucio Acosta Castélum, 55, according to state police.
Rivas began his career with the Arriba Mí Sinaloa group and in 2006 went solo and began playing with the Guaruras. He is best known for the following songs, Brindo de Sangre, Morí, El Comander and Soy Yo.
Police continue their investigation into the deadly shooting and have no motive yet to why Rivas was targeted. No suspects have been detained.

Occupy Protesters Urinated And Defecated On Themselves While Detained In San Diego Sheriff's Vans

Some of the San Diego protesters were forced to urinate and defecate on themselves while being detained for long periods of time on sheriff's vans and buses.

San Diego, California - Recently, the San Diego Sheriff's Department (SDSD) launched an internal investigation to determine how some Occupy San Diego protesters that were arrested had been left on vans and buses for a long period of time resulting in self urination and defecation. About 50 protesters were taken into custody on October 26, at the downtown Civic Center Plaza and Children's Park encampments. Sheriff Deputies and San Diego police placed 36 men in buses and 14 women in vans, according to the SDSD.
Some of the men and women had to urinate and defecate on themselves before being booked because they were left on the vehicles for hours.
A SDSD statement sent to the San Diego City Beat said, “The Sheriff has directed that a Critical Incident Review be conducted internally. Also, the Sheriff’s Department and the Police Department will conduct a mutual debrief to examine in detail how the operation was handled. From those reviews we will determine how to improve our practices to assure that this does not happen again.”
In an unrelated urination and defection incident, an unidentified Occupy protester in Eureka, California publicly urinated and deposited human waste (defecation) outside the entrance of the 5th Street branch of the U.S. Bank on Nov. 4, according to a Eureka police biohazard investigation. Police reported, it was the second biohazard incident within a week.
In early October, biohazard reports surfaced that Occupy protesters had been urinating and defecating along the Wall Street financial district near encampments in New York. An unidentified man was caught by photographer Stefan Jeremiah and photo posted in the Daily Mail dot co dot uk showing the man defecating on a New York Police Department squad car in Manhattan.
This weekend, police in Portland, Oregon; Salt Lake City, Utah; Denver, Colorado; Oakland, California and in St. Louis, Missouri began clearing Occupy encampments and arresting protesters resisting to leave. Occupy protesters claimed, police are violating their rights to assembly under the First Amendment and in California, protest organizers are seeking an injunction to keep police from removing them from encampments.
In some Occupy encampments around the U.S., sexual assaults have been reported, trash and unsanitary conditions had risen and one person managed to commit suicide.
