Sevilla, the alleged shooter at Mayfair Mall in Wauwatosa in November 2020 will remain in juvenile court after a filed petition by the Milwaukee County District Attorney's Office to waive him to adult court was rejected by judge.

Wawautosa, WI - The 15-year-old shooting suspect identified as Xavier Sevilla from Milwaukee, who allegedly shot 7 adults and one teen at the Mayfair Mall in Wauwatosa on November 20th, will remain in juvenile court, according to a juvenile court hearing on Thursday. He will not be waived to adult court, because the prosecution failed to prove the "burden of support" to waive him into adult court, according to the presiding judge.
AP reported that, "Assistant Public Defender Paul Rifelj argued that the boy's personality was that of a child and that the treatment services available to him in the juvenile system would be best to help him."
Sevilla was charged in a petition of juvenile delinquency with 8 felony counts of 1st-degree reckless injury and one misdemeanor count for possession of a firearm by a person under the age of 18. if convicted, Sevilla will most likely remain in detention until he turns 18 and the juvenile conviction record will remain sealed.
Sevilla who was identified by Wisconsin Right Now dot com in December was on probation for a prior criminal offense and was not supposed to violate his conditions of probation.
According to police, Sevilla fled the scene by calling a Uber, which took him to his family residence. Police arrested the Sevilla a day after while traveling in a vehicle with Illinois plates. A Glock 9mm handgun was recovered when the teen was taken into custody. The suspect also had a packed bag and was attempting to flee the state.
