The Milwaukee Police Department is now facing a backlash for getting involved in a false U.S. ICE arrest of an undocumented man in the Southside of Milwaukee on Monday.

Milwaukee, Wisconsin - On Tuesday, U.S. Immigration and Customs Enforcement (ICE) officials including U.S. ICE Chicago Field Office Director Robert Guadian released the following statement to the mainstream media about Monday's arrest of undocumented Jose Alejandro De la Cruz-Espinosa, 38, in Milwaukee's Southside, "Regrettably, advocacy groups and others released inaccurate and misleading information about this recent arrest in Wisconsin. To be absolutely clear, U.S. immigration law provides ICE officers the authority to arrest aliens without a judicial warrant. Falsehoods advocated by individuals and groups with their own agenda widely spreads misinformation and may inspire some to violence."
Newsweek also reported that Guadian said on a statement to them that, "To be clear, ICE does not ask local law enforcement agencies to enforce immigration law," Guadian said. "ICE called for MPD assistance, as we would any local law enforcement agency, when the situation appeared to escalate to ensure the safety of everyone involved." But in this case in Milwaukee, an MPD officer was used to illegally reach inside the vehicle through a partially open window and unlock the vehicle's locked doors without a warrant and De la Cruz was forced out of the truck by an officer, which an officer at the scene during a video recorded at the scene says was for a probation violation, which had just been entered in a computer at the scene of the incident when there was no active probation violation hold for De la Cruz and then police turned him over to ICE custody, which was another illegal act by MPD police from District Station 2, since they had apparently had him on a frivolous state misdemeanor probation violation hold to coverup their illegal acts.
Also a statement from Nicole Alberico, the U.S. ICE spokesperson says, "Jose Alejandro De la Cruz-Espinosa, 38, is a citizen of Mexico who is illegally present in the U.S. On Sept. 23, 2019, deportation officers with U.S. Immigration and Customs Enforcement (ICE) arrested De la Cruz-Espinosa in Milwaukee, Wisconsin. He has a criminal history that includes several criminal offenses in Wisconsin's Brown and Marathon counties.
"As ICE officers were effecting this arrest, De la Cruz-Espinosa was uncooperative and refused to exit his vehicle or follow lawfully issued commands. After some time, De la Cruz-Espinosa complied with officers. Ultimately, ICE officers arrested De la Cruz as he was stepping out of the car.
"De La Cruz-Espinosa remains in ICE custody pending the disposition of his immigration case."

(HNNUSA) did a criminal record check for Jose Alejandro De la Cruz-Espinosa, 38, and found no additional criminal records in Brown and Marathon Counties in Wisconsin within the last 10 years available in CCAP as U.S. ICE claims other than the conceal carry misdemeanor conviction in April 2019, according to Wisconsin court records.
ICE officials are known to lie when incidents involving rogue ICE agents that engage in illegal activities. It seems that the Milwaukee arrest of De la Cruz-Espinosa on Monday was another illegal act, since ICE agents had no warrant for his arrest and according to Guadian, ICE agents don't need an arrest warrant to take suspected undocumented individuals into custody in a public setting.
So, according to the U.S. Constitution, federal and state court rulings, a police officer when stopping a driver for a traffic violation, the officer needs to ask permission to search a vehicle and probable cause of an infraction committed is needed, especially if the driver is driving while intoxicated, an officer can arrest an individual or if the individual has a judicial warrant for his/her arrest.
The federal court rulings and U.S. Constitutional rights for individuals should also extend to U.S. ICE agents on the field, but according to ICE it doesn't.
In the Wisconsin case, ICE agents blocked the vehicle where De la Cruz-Espinosa and his family were in and had to flag a passing police officer to help them make an arrest. At least eight ICE agents were at the scene and multiple police officers arrived including a K-9 dog unit just to arrest De la Cruz-Espinosa on a false probation violation allegation by ICE agents, which according to a police officer who was video recorded had stated that they had just entered his probation violation on the computer.
What does it indicate?, that Milwaukee police officers at the scene were lied too by ICE agents and ICE agents needed a cop to violate the De la Cruz's family Constitutional rights by having the cop reach through the open driver's side window with his hand and unlocked the vehicle doors without permission or a judicial warrant and then took De la Cruz-Espinosa into custody.
De la Cruz-Espinosa was forced out of the vehicle (truck) by Milwaukee police and he did not voluntarily step out of the vehicle as ICE claims, according to a short video recorded by the family while inside the vehicle. Also, Guadian stated that, "Falsehoods advocated by individuals and groups with their own agenda widely spreads misinformation and may inspire some to violence", which is inaccurate and false, to date, no one has committed any act of violence against any rogue ICE agents that have been recorded committing illegal acts around the U.S. including Wisconsin.
In many cases, ICE rogue agents and police officers who engage in illegal activities and violate the Constitutional rights of people of color are not held accountable by ICE, the U.S. Department of Homeland Security or U.S. Department of Justice. These rogue ICE agents and police officers found to commit illegal acts upon the very same people of color that pay their salaries should be terminated, but in many cases, ICE agents are transferred to other parts of the country without facing any accountability.
