Waco, Texas - On Wednesday, Las Vegas Attorney Steven P. Stubbs posted a YouTube video detailing what eyewitnesses have told him about what actually transpired on May 17, 2015 at the Twin Peaks Restaurant parking lot where nine bikers were reported killed during a three rival club biker brawl that involved police as well. According to Stubbs, about one hundred of the Cossacks and Scimitars M.C's around 11:30 a.m. arrived at the Twin Peaks Restaurant to attend a bi-monthly Texas Confederation of Clubs and Independents (TCCI) biker political meeting dealing with legislative bills, biker rights and safety concerning the Texas biker community. Apparently, the Cossacks and Scimitars were not known to attend such meetings, weren't expected at the TCCI meeting and had not been invited, according to Stubbs.
After 12:13 p.m., a group of members from the Bandidos M.C. arrived and parked their motorcycles without incident and most went into the Twin Peaks Restaurant to get food and drinks. Around 12:20 p.m., a second group of 7 to 9 Bandidos arrived and went into a parking lot area where the Cossacks had their motorcycles parked and were open spaces to park. A Scimitars member stepped in front of the Bandidos trying to park in the lot and told them not to park where the Cossacks and Scimitars were parked.
An argument followed, the Bandidos were still on their motorcycles and unarmed, according to Stubbs. About 50 Cossacks and Scimitars surrounded the Bandidos and began to physically attack the Bandidos who began to defend themselves with fists and their helmets. Three Cossacks unholstered their weapons and one shot a Bandidos in the shoulder. Another Cossacks was seen firing a gunshot from the Twin Peaks Restaurant outdoor patio into the crowd, but it is not known who he shot at.
Moments later, witnesses heard police sniper rifle fire and 100's of rounds of gunfire. Stubbs says, that most of the gunshot rounds were fired by police and a SWAT team into the crowd of Cossacks, Scimitars and the small group of Bandidos. Seven Cossacks, one Bandidos and a Bandidos affiliate were killed by police gunfire. At least 27 other bikers were injured by police gunfire as well.
Stubbs says, that an undercover cop known as "Voodoo" infiltrated the Cossacks and had pushed for the Cossacks and Scimitars to attend the TCCI meeting at the Twin Peaks. Stubbs did not identified for which law enforcement agency the undercover cop worked for.
A video released to the Associated Press shows a Cossacks pulling out a handgun and shooting a Bandidos in the shoulder. But, video surveillance from the Don Carlos Restaurant showing the section where the brawl took place would also show how police massacred the bikers and wounded 27 other bikers, according to Stubbs. Police has not released the Don Carlos parking lot video to media.
Waco police arrested 177 bikers and filed a frivolous charge for engaging in organized crime at the Twin Peaks when actually most bikers were legally attending a TCCI meeting. Hispanic News Network U.S.A. (HNNUSA) has learned that Waco Police Detective Manuel Chavez wrote the same felony criminal warrant affidavits for most of the bikers arrested on May 17 and had them signed illegally by Justice of the Peace Walter H. Peterson who also set a $1M bond for all those arrested to "send a message." Peterson who is not trained in legal proceedings and is not an attorney violated state statues by signing the warrants and setting excessive bonds for the bikers. Peterson is not allowed to handle felony cases and set bail in the state of Texas. McLennan County District Attorney Abel Reyna and Waco Police Chief Brent Stroman knew that Peterson couldn't legally sign the warrants and set excessive bonds, but they kept quiet and have not commented about the illegal arrests of most of the bikers taken into custody at the Twin Peaks. The incompetence by Detective Chavez, Peterson, D.A. Chavez and Chief Stroman in filing such frivolous charges and allowing for the $1M bond to stand for at least 16 days only indicates the deep corruption and mass violation of Civil Rights and Constitutional rights of bikers by the City of Waco and McLennan County officials.
Allegations have been raised that the Waco police and the McLennan County D.A.'s Office could be editing the video evidence recovered at the Twin Peaks and the Don Carlos Restaurants in an attempt to cover up the Waco police biker massacre.
On Monday, McLennan County D.A. Reyna began to release some of the bikers represented by attorneys on lower bonds without conditions after allegations were raised that the McLennan public defender's office was circulating waivers for bikers to sign agreeing not to file lawsuits against Waco for illegal arrests in return for lower bonds to be release. Reyna denied the waiver allegation. Other bikers who have no attorneys will remain in custody, according to Reyna.
A civil rights federal lawsuit was filed on Friday by one of the bikers arrested, Matthew Clendennen, 30, against Waco police and the McLennan County D.A.'s Office. Clendennen's bail was reduced to $100K from $1M and was released without conditions. Clendennen's attorney filed a complaint against Justice of the Peace Peterson with the Texas Commission on Judicial Conduct claiming that Peterson illegally signed warrants without individual probable cause hearings, was bias and set excessive bonds for bikers violating his limited authority under state statues. The illegal procedures by Peterson was to buy time for local authorities to figure out what actually happened.
Another Attorney, Adam King Blackwell Reposa representing Jimmy Lee Pond, 43, filed for all the judges involved in the Waco shooting case to be recuse for allegedly unprecedented denial of due process, having bias and placing an excessive bond for his client.
A massive peaceful biker rally and protest against the frivolous charges and excessive $1M bail is scheduled for Sunday, June 7 at 12:30 p.m. in front of the McLennan County Court House to call upon D.A. Reyna to release the bikers on lower bail.
The following nine victims were killed during the Twin Peaks Restaurant biker altercation between the Bandidos and Cassacks M.C.s in Waco, Texas.
